Accommodation Sales Agreement
1. Parties:
SELLER (Service Provider/Intermediary) – FTS Tourism Congress Organization Services Trading Ltd. Co., the accommodation organization company (hereinafter referred to as the "SELLER").
BUYER (Consumer/Customer) – The individual who purchases the accommodation service through the official website of Into The Wild Festival.
2. Subject of the Agreement:
This agreement regulates the rights and obligations of the parties regarding the accommodation service purchased electronically by the BUYER through the SELLER’s website, in accordance with Law No. 6502 on the Protection of Consumers and the relevant Distance Contracts Regulation. The agreement includes the terms of sale and performance of the accommodation service, as well as the mutual declarations of the parties.
3. Service and Reservation Details:
The details of the accommodation service purchased by the BUYER are as follows:

Accommodation Facility and Service Type: The service type selected in the Application Form.

Accommodation Address: Kabak Bay (Address of the hotel or accommodation facility).

Accommodation Duration (Check-in/Check-out): Check-in from 12:00 on 16.05.2025, check-out by 12:00 on 19.05.2025.

Other Terms: Services included in the accommodation package (e.g., breakfast/dinner) and excluded additional services (e.g., lunch, minibar, spa, etc.) are specified at the time of purchase. The BUYER acknowledges that they have reviewed the scope and nature of the selected accommodation package before purchase.
4. Sale Price and Payment Terms:
4.1. Service Fee: The total price of the accommodation service, based on the type selected by the BUYER on the website, is stated in the approval mail. (including all taxes, including VAT). Prices and commitments advertised on the website are valid until updated, and promotional prices are valid until the specified deadline.
4.2. Payment Method: The BUYER agrees to pay the total amount either in full or in installments, if offered by the SELLER. The SELLER may accept bank transfer/EFT, credit card (single or installment payments), or similar methods. The BUYER must provide accurate and complete payment details. For installment payments, applicable interest rates and terms are subject to the relevant bank’s policies.
4.3. Payment Time and Formation of the Agreement: The BUYER is obligated to pay the total service fee as specified during the purchase. The agreement is deemed concluded and effective upon the BUYER’s electronic confirmation of this agreement and full payment. The SELLER will not finalize the reservation or fulfill the agreement until full payment is received. (Upon payment confirmation, the BUYER will receive an electronic confirmation and a copy of the agreement.)
4.4. Bank Card Payment Information: If the BUYER pays by credit card or in installments, refund processes will follow the bank’s procedures. If the SELLER approves a cancellation/refund request, the refund will be processed within 14 (fourteen) days only to the original payment method. The reflection of the refund on the card statement depends on the bank’s internal processes. The SELLER has no control over this process and cannot be held liable for delays. The BUYER agrees to address early payment or installment adjustment requests directly with their bank.
5. Tax Status:
The service fee includes Value Added Tax (VAT). All prices stated by the SELLER are inclusive of legal taxes unless otherwise specified. No additional fees or taxes will be charged to the BUYER unless explicitly agreed upon in advance.
6. Cancellation and Refund Terms:
6.1. BUYER’s Cancellation Request: If the BUYER voluntarily cancels the accommodation service, the following terms apply:

Early Cancellation (Written request submitted at least 45 days before check-in): A 10% deduction (including bank and administrative fees) from the total amount paid.

Late Cancellation (e.g., within 14 days or less): No refund will be issued if the cancellation request is made less than 45 days before check-in or in case of a no-show. The BUYER is liable for the full service fee.

The BUYER must submit cancellation requests via the SELLER’s designated written communication channels (e.g., email). Valid refunds will be processed within 14 days via the original payment method.
6.2. Partial or Non-Use of Service: If the BUYER does not check in or shortens their stay, no refund will be issued for unused services. Early departure or service refusal must be communicated in writing with valid justification to the SELLER and the accommodation facility. Otherwise, non-use is deemed voluntary, and no refund will be granted.
6.3. SELLER’s Cancellation or Modification Rights: The SELLER reserves the right to cancel or substitute the service with an equivalent alternative in cases of force majeure or unforeseen circumstances (e.g., facility-related issues). If the BUYER cannot attend due to valid reasons, they may transfer the reservation to another person with the SELLER’s approval.
In case of full cancellation, the SELLER will refund all payments received (or a prorated amount for partially used services). The BUYER waives any additional compensation claims in such cases.
7. Right of Withdrawal:
Under Law No. 6502 and the Distance Contracts Regulation, the BUYER generally has a 14-day right of withdrawal without justification. However, this agreement falls under the exception (Art. 15/1-(g) of the Regulation) as the accommodation service is tied to a specific date/period. By electronically approving this agreement, the BUYER acknowledges and accepts that the right of withdrawal does not apply.
8. Pre-Contract Information and Legal Obligations:
8.1. Pre-Contract Information Form: The BUYER confirms having reviewed and approved the Pre-Contract Information Form, which includes all details (price, payment terms, service features, cancellation policies, etc.) before purchase. The SELLER is obligated to retain electronic records of this approval.
8.2. Copy of the Agreement: A signed copy of this agreement and the Pre-Contract Information Form will be sent to the BUYER’s email or via a permanent data storage medium. The BUYER may also access the agreement through their account on the SELLER’s website.
8.3. Timely Performance: The SELLER or service provider must deliver the accommodation service as agreed. Failure to do so (e.g., unjustified cancellation) entitles the BUYER to terminate the agreement. Upon termination, the SELLER must refund all payments within 14 days. The BUYER waives any additional cost or interest claims.
8.4. Impossibility of Performance: If the service becomes impossible to provide (e.g., facility closure), the SELLER must notify the BUYER within 5 days and refund all payments within 14 days.
8.5. Additional Payments: The SELLER cannot unilaterally charge extra fees beyond the agreed price, except for additional services requested by the BUYER.
8.6. Personal Data: The BUYER consents to the processing of their personal data by the SELLER, as outlined in the Privacy Notice at www.intothewildfest.com.
9. Accommodation Terms and Liabilities:
9.1. Check-in/Check-out: The BUYER acknowledges that check-in is no earlier than 14:00 and check-out no later than 12:00. Late check-out may incur extra charges.
9.2. Included/Excluded Services: The fee covers only specified services (e.g., breakfast/dinner). Additional services (e.g., spa, transportation) are the BUYER’s responsibility.
9.3. Health and Safety: The SELLER is not liable for unforeseen events (e.g., weather, allergies, food poisoning). The BUYER assumes personal responsibility for outdoor/nature-related risks.
9.4. Force Majeure: Natural disasters, pandemics, government actions, etc., exempt parties from liability. The SELLER may refund or substitute the service per Clause 6.3.
9.5. Weather Conditions: Adverse weather or unmet expectations do not warrant refunds unless deemed force majeure.
9.6. Defective Service: Complaints must be reported immediately in writing. Unjustified early departure forfeits refund rights.
9.7. Invoice Issuance: Invoices will be sent to the BUYER’s provided address post-stay. Incorrect addresses relieve the SELLER of liability.
10. Electronic Approval and Effectiveness:
The BUYER confirms understanding and acceptance of all terms by electronically approving this agreement. The agreement is binding upon payment and confirmation. The SELLER will securely store electronic records.
11. Notices and Contact Details:
Parties designate the contact details in this agreement for official communications. Email notices are deemed received upon sending. Address changes must be promptly notified.
12. Governing Law and Jurisdiction:
Disputes will be resolved under Turkish consumer protection laws. The BUYER may file claims with Consumer Arbitration Boards or Courts in their jurisdiction. The SELLER’s location cannot be designated as the exclusive venue.
13. Effectiveness and Acceptance:
This agreement is legally binding upon the BUYER’s electronic approval. The BUYER confirms reading, understanding, and accepting all terms, including the right to request a printed copy.
